Welcome to Fizzen. These Terms of Service ("Terms") govern your access to and use of drinkfizzen.com (the "Site") and the products we sell through it. By using the Site or placing an order, you agree to be bound by these Terms. If you don't agree, please don't use the Site.
1. Who we are
The Site is operated by Fizzen Beverage Co. ("Fizzen," "we," "us"). You can reach us anytime at hello@drinkfizzen.com.
2. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase from the Site. By placing an order, you represent that you meet this requirement.
3. Products and pricing
We do our best to accurately describe every product and display current pricing. Colors, imagery, and nutritional information are provided as accurately as possible, but we can't guarantee that your screen will reproduce them perfectly.
Prices are shown in U.S. dollars and are subject to change without notice. We reserve the right to correct pricing errors, refuse or cancel orders based on incorrect listings, and limit order quantities. Taxes and shipping are added at checkout.
4. Orders and payment
Placing an order is an offer to purchase; we accept the offer when we ship the product. We may refuse or cancel any order in our discretion, including for suspected fraud, pricing or stock errors, or violations of these Terms. Payment is due at the time of order via the payment methods displayed at checkout.
5. Shipping and delivery
We ship to the 50 United States. Estimated delivery times are just that — estimates. Risk of loss and title pass to you when your order is handed to the carrier. If your order arrives damaged or is lost in transit, email hello@drinkfizzen.com within 14 days of shipment and we'll make it right.
6. Returns, refunds, and subscriptions
Because Fizzen is a perishable beverage, we don't accept returns of opened or unopened product for refund. If your order arrives damaged, wrong, or defective, we'll replace it or refund it — just email us within 14 days with a photo.
Subscriptions renew on the cadence you selected at signup. You can skip, pause, change flavors, or cancel anytime from your account before the next renewal date. Charges that have already processed are final.
7. Intellectual property
All content on the Site — including the Fizzen name, logo, graphics, photography, and product designs — is owned by Fizzen or our licensors and protected by copyright, trademark, and other laws. You may not reproduce, modify, or commercially use anything from the Site without our written permission.
8. User content
If you submit reviews, photos, comments, or other content to the Site or tag Fizzen on social media, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and repost it in our marketing. You're responsible for making sure you have the rights to anything you share.
9. Acceptable use
Don't use the Site for anything unlawful or to infringe anyone's rights. Don't scrape, reverse-engineer, or interfere with the Site. Don't impersonate anyone or misrepresent your affiliation with us.
10. Health, allergens, and nutrition
Fizzen contains dairy and is made with real fruit juice, whey protein isolate, and collagen peptides. If you have allergies, sensitivities, or specific dietary needs, please read the full ingredient list on each can before consuming. The Site's content is for general information and isn't medical advice. Consult a healthcare professional before making changes to your diet.
11. Disclaimers
The Site and products are provided on an "as-is" and "as-available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, Fizzen will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our products. Our total liability for any claim related to an order will not exceed the amount you paid for that order.
13. Indemnification
You agree to indemnify and hold Fizzen harmless from any claims, damages, or expenses arising out of your use of the Site, violation of these Terms, or infringement of any third-party rights.
14. Governing law and disputes
These Terms are governed by the laws of the State of Tennessee, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Davidson County, Tennessee, and you consent to the personal jurisdiction of those courts.
15. Changes to these Terms
We may update these Terms from time to time. The "Last updated" date above tells you when. Material changes will be posted to the Site; your continued use after changes means you accept them.
